1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Medlobby LLC ("Medlobby", "we", "us", or "our") governing your access to and use of the Medlobby platform, including all subdomains, applications, and services (collectively, the "Platform").

By creating an account, accessing, or using the Platform in any way, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Platform.

3. Subscriptions, Payments, and Refunds

Subscription Plans: Medlobby offers free and paid subscription tiers. Paid plans are billed on a monthly or annual basis as selected at checkout.

Payment Processing: All payments are processed securely by Stripe. By subscribing, you authorise Medlobby to charge your chosen payment method on a recurring basis. We do not store raw card details.

Auto-Renewal: Subscriptions renew automatically at the end of each billing period. You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period.

Refund Policy: We offer a 7-day money-back guarantee on initial subscription purchases. Refund requests must be submitted to support@medlobby.com within 7 days of purchase. Renewal charges and digital content (PDF guides, downloadable materials) accessed after purchase are non-refundable.

Price Changes: We may change subscription prices at any time. We will give you at least 30 days' notice before a price change affects your subscription.

4. Intellectual Property

Medlobby Content: All content on the Platform — including but not limited to clinical question banks, explanations, course materials, videos, software, and design ("Medlobby Content") — is the exclusive property of Medlobby and its licensors and is protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for your personal, non-commercial educational purposes. You may not reproduce, distribute, modify, create derivative works of, or commercially exploit any Medlobby Content.

Your Content: You retain ownership of content you create on the Platform (notes, annotations, saved items). You grant Medlobby a limited licence to store and display this content solely to provide the service to you. You may delete your content at any time.

It is not intended to be and must not be taken as a substitute for professional medical advice, clinical judgment, diagnosis, or treatment. AI-Generated Content: The Platform may include AI-assisted content and question generation. Such content is for supplementary study only and may contain errors or inaccuracies. You must independently verify all AI-generated information before relying upon it.

6. Acceptable Use

You agree not to use the Platform to:

• Violate any applicable laws, regulations, or professional codes of conduct.
• Share, transfer, or sell your account credentials or subscription to any other person.
• Scrape, crawl, copy, reverse-engineer, or systematically download Platform content.
• Attempt to gain unauthorised access to any part of the Platform or its infrastructure.
• Upload or transmit any malware, viruses, or malicious code.
• Harass, abuse, defame, or harm any other user or third party.
• Misrepresent your identity, credentials, or professional status.
• Use the Platform for any commercial purpose without our prior written consent.

Violation of these provisions may result in immediate account suspension or termination without refund.

7. Copyright Infringement (DMCA)

We respect intellectual property rights. If you believe content on the Platform infringes your copyright, please submit a DMCA notice to our Copyright Agent at dmca@medlobby.com including:

• Your signature (physical or electronic) as the copyright owner or authorised representative.
• Identification of the copyrighted work and the allegedly infringing material.
• Your contact information (name, address, telephone, email).
• A statement of good faith belief that the use is not authorised by the copyright owner.
• A statement under penalty of perjury that the information provided is accurate.

8. Disclaimers and Limitation of Liability

The Platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the fullest extent permitted by applicable law, Medlobby shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of revenue, or loss of profits, arising out of or in connection with your use of or inability to use the Platform, even if we have been advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim.

9. Termination

We reserve the right to suspend or permanently terminate your account, without prior notice or liability, for any conduct that we determine, in our sole discretion, violates these Terms or is harmful to the Platform, other users, or third parties. Upon termination, your right to use the Platform ceases immediately.

You may terminate your account at any time by contacting us at support@medlobby.com. Sections 4, 5, 8, and 10 shall survive termination.

10. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Platform shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in Wyoming, USA, in accordance with the American Arbitration Association rules.

You agree to bring claims only in your individual capacity and not as a plaintiff or class member in any class action.

11. Changes to These Terms

We may revise these Terms at any time. We will provide at least 14 days' notice of material changes via email or a prominent notice on the Platform. Your continued use of the Platform after the effective date constitutes your acceptance of the revised Terms.
